Contributions Urgently Needed for ‘Farmer Travel Fund’ to Enable Family Farmers to Attend Court Session

WASHINGTON, ME – November 23, 2012 – On November 21, 2012, the Court of Appeals for the Federal Circuit in Washington, D.C., announced that it would hear the Appeal of Dismissal in Organic Seed Growers and Trade Association et al v. Monsanto at 10am on Thursday, January 10, 2013. The landmark organic community lawsuit was originally filed in Federal District Court, Southern District of New York, in March 2011.

OSGATA et al v. Monsanto challenges the validity of Monsanto’s transgenic seed patents and seeks preemptive court protection for farmers when Monsanto seed trespasses onto their farms and contaminates their crops. Should contamination occur, innocent farmers would be placed in legal jeopardy and could be held liable by Monsanto for patent infringement because of the farmers’ “possession” of Monsanto technology without having paid royalty on that “possession.”

Plaintiffs are being represented in the case by lawyers from the Public Patent Foundation, who are providing their legal services to the farmers pro bono. Plaintiff lawyer Dan Ravicher asked Monsanto for a binding legal covenant guaranteeing family farmers that they would not be pursued for patent infringement should they become contaminated by Monsanto seed. Monsanto refused to provide this assurance to the farmers.

The farmers’ Appeal brief, filed last summer, cites legal and factual errors by Federal District Court Judge Naomi Buchwald which in toto caused her to erroneously conclude that the farmers lacked standing under the Declaratory Judgment Act to seek court protection. In addition, two powerful Amicii briefs were filed in support of the farmers’ position – one by a group of eleven law professors and another by a group of fourteen non-profit agricultural and consumer organizations. These briefs will be studied by the three judge Appellate panel during their deliberations.

“American family farmers have gone to court seeking justice and protection from Monsanto. We are not seeking one penny from Monsanto,” said Maine organic seed farmer Jim Gerritsen, President of lead Plaintiff Organic Seed Growers and Trade Association. “We satisfy the requirements of the Declaratory Judgment Act. We want our day in court so that our families can achieve protection from this perverse injustice. We are prepared to prove at trial that the U.S. Patent Office improperly granted Monsanto patents on their genetically engineered seed and that those patents are invalid.”

OSGATA has re-established its Farmer Travel Fund in order to raise funds to enable family farmers to travel to the Oral Argument in January. The Farmer Travel Fund is in immediate need of contributions to support this convergence of farmers from across the United States in solidarity for the OSGATA et al. v. Monsanto lawsuit effort. Plaintiffs believe it is critical that the courtroom for the Oral Argument of this major lawsuit be filled with concerned Plaintiff-farmers in order to visibly demonstrate that the case is not just an academic dispute of patent law. Rather it is a monumental issue affecting the rights of American family farmers, with implications of global significance.

WASHINGTON, DC – On Wednesday, October 17, 2012, Occupy Monsanto’s field agents with the Genetic Crimes Unit (GCU), a group whose aim is to expose Monsanto’s crimes against farmers, the environment, and human health, will visit both the Republican and Democratic party headquarters in Washington DC. The GCU opposes genetically engineered food (GMOs) and seeks to expose Monsanto’s ties to both parties who have, for too long, protected agribusiness interests over that of the 99% of Americans who want healthy and safe food.

The protests at the two major party headquarters is the 70th Occupy Monsanto demonstration this year. Biohazmat-clad “Agents” have repeatedly addressed Obama’s ties to the GMO debate, pointing out that in his 2007 election bid he promised to have genetically engineered food labeled after being elected.

"We demand that Romney and Obama come clean on their ties to Monsanto and fight for the health of Americans over chemical company profits," said Adam Eidinger. "The fact that FDA Food Safety Czar Michael Taylor, former lobbyist and lawyer for Monsanto, was appointed by Barack Obama to make decisions on food safety is a disgrace," adds Eidinger.

"Mitt Romney has been instrumental to Monsanto’s success, and we have no indication that he will change his ways if elected." Rica Madrid said. Romney’s early consulting for Monsanto was effective in shifting Monsanto’s strategy from a focus on reputation-tarnishing chemical compounds to genetically engineered food and the profitable RoundUp weed killer. Romney was so effective that then-Monsanto CEO John W. Hanley helped him create Bain Capital.

WASHINGTON, DC – Occupy Monsanto, a decentralized network of food activists who organized 65 protests at GMO manufacturer Monsanto facilities across the globe this week, is calling on the Barack Obama Administration to clean house of appointed former Monsanto executives who intentionally ignore the serious health impacts of eating genetically engineered food due to their conflict of interest. A new GMO food study released today gives alarming evidence of GMO-induced lethal health complications in rats. The data casts an ominous shadow on the Food and Drug Administration (FDA) where imperative consumer regulation of GMOs is handled by former Monsanto executives. “Activists are renewing their push for the FDA to review the long term safety of GMO food prior to its introduction to the food supply,” says Occupy Monsanto spokesperson Gene Etic. “European researchers confirmed today rats fed GMO food developed tumors and other serious health problems at an alarming rate compared to the control group. It isn’t too soon to pull GMO’s out of the food supply based on today’s news. The FDA has an obligation to protect people from unhealthy food but as long as former Monsanto executive Michael Taylor is running food safety for Obama nothing will be done to protect Americans.”

Absent a new approach by the Obama Administration, the new study will fuel more GMO protests that are increasingly becoming disruptive as demonstrated last Wednesday, September 12, when activists calling themselves the Genetic Crimes Unit (GCU) shut down shipping and receiving access points at Monsanto’s massive Oxnard, California GMO seed factory. By peacefully blockading the exit and access points at the factory, the group shut down the distribution of genetically engineered (GMO) seeds for a day.

“If the government refuses to stop the distribution of deadly GMO seeds in the food supply, more and more activists will engage in acts like last week that stopped GMO seed distribution for about 6 hours in the state of California,” says Ariel Vegosen who was arrested with 8 others in Oxnard and charged with trespassing.

Monsanto is the largest producer of GMO seeds. Over 75 Protests to Target Makers of Genetically Engineered Foods on Anniversary of Occupy Movement

WORLDWIDE – An expanding network of concerned individuals known as Occupy Monsanto has emerged over the past 9 months staging numerous protests at companies connected to the global trade of genetically engineered foods, also known as GMOs. The network announced today that on September 17, 2012 protests will begin for an entire week in St. Louis, home of the Monsanto Corporation, and across the US including California where voters will decide if they will label GMOs this election and worldwide in Argentina, Canada, Germany, India, Spain, Philippines, Paraguay and other countries where concern over GMO impact on the environment and human health is growing.

Occupy Monsanto means to confront the industrial agriculture system head-on. Some protests could result in widespread arrests of people who choose to engage in non-violent civil disobedience. Despite the peaceful nature of these planned protests, organizers are concerned about surveillance of Occupy-Monsanto.com by the US Department of Homeland Security and law enforcement agencies worldwide. Nevertheless Occupy Monsanto protests will feature costumes made of bio-hazmat protective gear that can also protect against pepper spray from police who have routinely attacked occupy protests in the past year.

“Wall Street and the American political elite have underestimated and even ignored our potential to effect rational policy change on GMOs which would include labeling for GMOs and restrictions on GMO cultivation,” says Gene Etic an anti-GMO campaigner based in Washington, DC. “If Occupy Monsanto’s anti-GMO actions are successful, after September 17 the media and increasingly more voters will ask tough questions about these experimental GMO crops especially within the context of the Presidential election, as that office holds the power to determine American food policy,” says Etic.

“People are stirred by the evidence that GMO foods compromise human health,” says Rica Madrid, a member of the Genetic Crime Unit of Occupy Monsanto. “Politicians and their sponsoring corporations ignore public outcry over GMOs to protect huge profits over health. Since GMOs’ introduction to the food supply in the mid 1990’s, food allergies have expanded according to Center for Disease Control data,” says Madrid.

“By purchasing influence via massive campaign donations, Monsanto ensures the essential duties of the Food and Drug Administration (FDA) are neglected. One example of this corporate coup is President Obama’s appointment of Michael Taylor, former Monsanto Vice-President and legal council for the chemical company, to head the FDA’s food safety efforts despite his obvious conflict of interest,” says Ariel Vegosen, a member of the Genetic Crimes Unit. She adds, “Monsanto is the biggest maker of genetically engineered crops so it must be stopped before it is too late to shift to healthy organic agriculture practices as a result of widespread genetic contamination by GMOs. ‘Coexistence’ as defined by the USDA of Organic and GMO crops is a myth.”

“At the US State Department it’s apparent Monsanto has duped leaders in Africa to ask the US for foreign aid in the form of GMO technology and equipment,” says Monsanto shareholder Adam Eidinger who last year walked from New York to the White House in Washington, DC with hundreds of other food activists to demand labeling of GMO foods. “The generous use of US tax dollars, endorsed by the likes of rock-star Bono and Secretary of State Hillary Clinton, a former legal council for Monsanto, is actually another taxpayer funded subsidy for Monsanto’s pesticide and herbicide hungry crops.”

Occupy Monsanto will be heard at the offices and facilities linked in the GMO food system. 9 Arrests Made at GMO Seed Distribution Plant

OXNARD, CA – On Wednesday, September 12 activists calling themselves the Genetic Crimes Unit (GCU) shut down shipping and receiving access points at Monsanto’s Oxnard seed distribution facility located at 2700 Camino Del Sol. By peacefully blockading the exit and access points the group effectively shut down the distribution of genetically engineered (GMO) seeds for a day.

Monsanto is the largest producer of GMO seeds and is being called out for their genetic crimes by a network called Occupy Monsanto. Today’s protest is the beginning of a series of over 65 different autonomous actions that officially start on September 17, a year since Occupy Wall Street movement began. Actions are planned throughout the world including the US, Germany, Canada, India, Paraguay, Philippines, Poland, Argentina, Australia, Spain, Russia, and Japan. After occupying all three shipping and receiving entrances to the Monsanto facility using flashy theatrics including a car with a giant “fish-corn” on top of it and a 6-foot high jail cell complete with someone dressed up like the CEO Hugh Grant of Monsanto inside. Eventually after 5.5 hours the fire department was called in and 9 anti-GMO activists were arrested and charged with trespassing.

“The reason I am occupying Monsanto and willing to put myself at risk of arrest is because Monsanto has genetically engineered food crops to contain novel untested compounds that result in more weed killer sprayed on our food, without informing consumers. Unlike most industrialized countries including every country in Europe, Japan and even China, in America right now there are no labels on our food informing us whether we are eating GMOs or not. We have a right to opt out of this experiment: it’s not up to chemical companies what I feed myself and my family. Monsanto has bought and sold both parties and has handpicked henchmen at FDA and USDA making sure we are kept in the dark. Monsanto is also currently fighting the California Prop 37 GMO labeling initiative that would give consumers the right to know if they are eating GMO foods. said GCU member Ariel Vegosen.

The GCU arrived onsite wearing bio-hazmat suits and with giant banners saying the “99% V. Monsanto” and “Seminis and Monsanto bringing weed killer GMO food to your table.” Next week there will be more protests all over the nation.

“In the name of Wall Street profits, chemical corporations such as Monsanto genetically engineer crops to withstand high doses of their toxic weed killers that contaminate our food and water, and have not been proven safe. We deserve to know what we are eating and we should put the GMO crops back in the lab and off the kitchen table.  The US chemical lobby has so far made sure Americans are kept in the dark and we are tired of inaction by Obama, “ said GCU unit member Rica Madrid.

Food Activists Demand Trader Joe’s Provide Proof Foods Sold in Stores are not Contaminated by Monsanto

WASHINGTON, DC— On Sunday, July 29, 2012, Occupy Monsanto’s agents of change with the Genetic Crimes Unit (GCU), a group designed to protect America from genetically modified foods, will ‘Shop for Truth’ at Trader Joe’s during a nationwide weekend of activism targeting the chain grocer. The DC-area GCU will gather in hazmat suits at noon outside the Trader Joe’s location at 1101 25th St. NW, Washington, DC to demand that the Monrovia, California-based Trader Joe’s provide proof that the foods sold in their stores under their own brands are free of Monsanto’s patented genes.

According to the Trader Joe’s website, the grocer sources all ingredients for its private label brands from non-genetically engineered crops, but provides no proof of this claim, nor does the grocer work with any known 3rd party verification services. The GCU believes that Trader Joe’s may be genetically contaminated by Monsanto’s gastronomical experiments and will be joining other GCUs from San Francisco, California to Portland, Maine over the weekend to demand that Trader Joe’s go beyond mere assurances and provide its customers with proof of their claims.

“If Trader Joe’s takes pride in the food they sell, why do they hide the truth from their customers?” asks GCU Agent Stacey Sanchez, “We don’t trust corporations like Trader Joe’s that have a profit motive, so the burden of proof lies in the corporate offices of Trader Joe’s.” The DC-area GCU has reason to believe that Trader Joe’s non-private label foods, which are not certified USDA Organic and contain corn, soy, canola, or sugar beets, are likely to be contaminated with genetically engineered ingredients.

“We will not spend thousands of dollars to send Trader Joe’s foods to laboratories for testing, instead we want Trader Joe’s to come clean,” says GCU Agent Richard Smith, “Trader Joe’s could easily become America’s first certified GMO-free grocery chain, but they won’t as long as they’re selling so called non-GMO foods without proof.”
